Small Group Vows to End Live Music & Outside Dining in Dana Point!
Help Bring Music Back to StillWater!
StillWater is sad to announce that it is being forced by the Alcoholic Beverage Commission to cease all live music until further notice. This includes the numerous charitable fundraising events, school/class performances, community events and professional entertainment we regularly host at our location.
The “Estates” as they refer to their enclave and Bob Theel – a potential developer of a nearby property – are secretively and aggressively trying to eliminate music and outside dining in Dana Point.
They are determined to prevent the revitalization of the Town Center — A project that the voters overwhelmingly supported and the City has already spent millions on to help generate business and create a vibrant downtown.
They feel that their money and perceived status entitles them to override the will of the people for their own personal and financial gain. This is a lose, lose situation for everyone except the six Lantern Bay Estates residents and Bob Theel who have complained.
Their letter complaint campaign has manipulated the ABC to issue fines and possible suspension of our license.
Although the Dana Point Chief of Police has written letters of recommendation and confirmed that we have not violated any City noise ordinances, the ABC has chosen to enforce its own subjective standard on whether any noise, at any level can be heard beyond our premises.
The ABC acknowledged it used no decibel meters and that this is an un-measureable standard. It has chosen to go against business and side with an elite few.
StillWater is only the latest victim of this group who has publicly stated they would like all outside noise and music eliminated from the Town Center. The Estates have complained about noise from the Harbor, traffic, StillWater and the Marriott Hotel to name a few.
They were the ones responsible for the elimination of all but two Music in the Park Concerts at Heritage Park. Their complaints have been rebuffed by the City and Police, because they are unwarranted. (Similar to complaints from people who buy houses next to an airport and then complain about plane noise.)
It is unfortunate that a few residents who are using their money and power for personal gain-can take away the rights of small businesses, local government and the rest of the community.
Our location has provided live music continuously since the late 1950s. Danny Brawner played on the patio for the original opening of Endless Summer and many local schools, musicians and community groups have performed on our stage.
During our renovation in 2012, we proactively removed the outside stage and took steps to circumvent noise actions which are unappreciated.
Live music is an art form we feel is worth fighting for. We are in the process of creating multiple ways by which the public can provide support and stop The Lantern Bay Estates Elite’ from using their money and influence to eliminate StillWater, music and outside dining in Dana Point.
